Legal guarantee of conformity

All products sold on this website are subject to "The UN Convention on Contracts for the International Sale of Goods".

To whom it applies

The Legal Guarantee is reserved for consumers. It applies only to users who have made the purchase on the Site for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity. Those who have purchased on the Site and who do not have the status of consumers will be subject to the guarantees for defects in the item sold, the guarantee for lack of promised and essential quality and the other guarantees provided for by the civil code with the related terms, forfeitures and limitations.

When it applies

The seller (with regard to purchases made on the Site, LASERSEA) is liable to the consumer for any lack of conformity existing at the time of product delivery that becomes apparent within one year of such delivery. The lack of conformity must be reported to the seller within 30 days of the date it was discovered, under penalty of forfeiture of the guarantee.

To benefit from the Legal Guarantee, the user must provide proof of the date of purchase and delivery of the goods. It is therefore advisable for the user, for such proof, to keep the order confirmation or the purchase invoice as well as the delivery note or any other document that can certify the date of purchase and the date of delivery (for example, the credit card statement or the bank statement).

What is a lack of conformity?

A lack of conformity occurs when the purchased good:

  • is not suitable for the use for which goods of the same type are normally used;

  • does not conform to the description given by the seller and does not possess the qualities of the goods that the seller has presented to the consumer as a sample or model;

  • does not have the usual qualities and performances of goods of the same type, which the consumer can reasonably expect, also taking into account the declarations made in advertising or on the labeling;

  • is not suitable for the particular use desired by the consumer and which was brought to the attention of the seller at the time of conclusion of the contract and which the seller has accepted.

Therefore, any faults or malfunctions caused by accidental events or by the user's responsibility or by use of the product that does not comply with its intended use and/or with what is provided in the technical documentation attached to the product are excluded from the scope of the Legal Guarantee.

Remedies available to the user

In the event of a lack of conformity duly reported within the terms, the user has the right:

  • primarily, to the free repair or replacement of the goods, at his choice, unless the requested remedy is objectively impossible or excessively onerous compared to the other;

  • secondarily (i.e., in the case in which the repair or replacement is impossible or excessively onerous or the repair or replacement has not been carried out within appropriate terms or the repair or replacement previously carried out has caused significant inconvenience to the consumer) to the reduction of the price or termination of the contract, at his choice.

The requested remedy is excessively onerous if it imposes unreasonable costs on the seller compared to the alternative remedies that can be pursued, taking into account

  • (i) the value that the goods would have if there were no lack of conformity;

  • (ii) the extent of the lack of conformity;

  • (iii) the possibility that the alternative remedy can be pursued without significant inconvenience for the consumer.

What to do in the event of a lack of conformity

In the event that a product purchased on the Site, during the period of validity of the Legal Guarantee, shows what could be a lack of conformity, the customer must contact Customer Service. LASERSEA will promptly respond to the communication of the alleged lack of conformity and will indicate to the user the specific procedure to follow, also taking into account the product category to which the product belongs and/or the reported defect.
Depending on the type of Product, Customer Service will indicate to the user whether:

  • (i) the product can be sent to LASERSEA for subsequent sending to the competent assistance center or

  • (ii) whether on-site assistance is foreseen.

It remains understood that LASERSEA is the entity responsible for the application of the Legal Guarantee.

In the first case, LASERSEA will collect the product and send it to the competent assistance center. In the second case, however, LASERSEA will agree with the user on a useful date for access to on-site assistance.

In any case, the competent assistance center will carry out the necessary checks to ascertain whether or not the defect of conformity complained of exists. In the event that the defect exists, if the user has chosen among the available remedies, the assistance center will proceed with the repair. If, however, the user has chosen replacement and this is not excessively expensive or objectively impossible for LASERSEA compared to the repair, LASERSEA will replace the product. If the assistance center finds a defect of conformity, any repair/replacement costs and those of transport to the assistance center will be borne by LASERSEA. If the assistance center does not find the defect of conformity, it will not be possible to apply the Legal Guarantee, and, therefore, the transport costs and any repair or replacement costs will be borne by the user. LASERSEA will inform the user of the circumstance and any costs incurred for the repair or replacement. LASERSEA reserves the right to send the user the estimate issued by the assistance center so that the user can decide whether or not to have the repair or replacement carried out at his own expense. The user must authorize the repair or replacement at his own expense in writing. Following such acceptance, a direct relationship will be established between the assistance center and the user, to which LASERSEA will be completely extraneous and for which no liability can be attributed to the same.

In all cases, the repair or replacement of defective Products, if due, will be carried out as quickly as possible and in any case, except in exceptional cases or causes of force majeure, within 30 calendar days from the day on which LASERSEA received the defective product. In the event that the replacement or repair initially chosen is not carried out within this period, the user may request one of the alternative remedies provided for by the Legal Guarantee (replacement, in the event that the repair was requested; repair in the event that the replacement was requested; reduction of the price or termination of the contract).

LASERSEA reserves the right to ask the user to attach the invoice relating to the order to the request to benefit from the Legal Guarantee of Conformity.
